12 for ’26 - Ebenezer Loveless Full-text Search Looking for Deed Purchase
After completing his timeline from records I already have, it was time to do full-text search. I searched in Chattooga County, Georgia; Faulkner County, Arkansas; and Texas records for the following surname variations: Loveless, Lovelace, Lovlace, and Lovless. Equally with variation of the first name: Ebenezer, Ebeneezer, Ebby, Ebbie, Eb, and E. The only records found are listed below. The main question I want to answer is how he obtained the land that was later sold.
Georgia
There were several hits from Bartow, Georgia, particularly probate records, for an Ebenezer Loveless who died around 1863. Since our Ebenezer Loveless was born 1851, this is not him. By 1862, the family was living in Chattooga County, Georgia. Any record after 1870 would likely not be him as his father, Jesse Loveless, had moved the family to Faulkner Co, Arkansas. In checking court, deeds, probate, and vital records, I found that court records are locked in Bartow County. Deeds are locked in Chattooga County. This search in Georgia needs to be repeated at a FamilySearch Center.
1. I found one result for a Confederate soldier named Ebenezer Lovless.
COMMENT: My Ebenezer was too young to fight in the war. This may be the Ebenezer Loveless who died around 1863.
2. I re-located the marriage of Ebby Loveless to E. A. Rodgers in Chattooga Co, Georgia, 19 Mar 1871.[1]
3. I found another version of the marriage, this one a certificate-looking document for the license and return.[2]
Arkansas
Most of the documents found for him
in Faulkner County, Arkansas, were with his first initial E. Loveless. It
appears that all films in Faulkner County are open from home. All the films
from Conway County are also open for view from home.
1. Deed. E. Loveless and A. E. Loveless to T. M. Richardson, 1 Nov 1881.[3] The land description was “Northwest quarter of the southwest [quarter] of Section 36 Township 7 North, Range 13 West and commencing at the southwest of said section and running east 32 rods, thence north 31 rods, thence west 22 rods, thence south 31 rods to the starting point, containing fourteen acres more or less, containing in the aggregate 54 acres.”
COMMENT: I have not found the purchase of this land. It does not seem to be part of the land inherited from his father, Jesse Loveless, who died in 1873. His father’s land was the southeast quarter of Section 36 in the same township and range. Although, I have not found how he obtained that land.
Faulkner County was created on 12 April 1873 out of parts of Conway and Pulaski Counties.[4] Described as “Beginning at the point where the township line dividing Townships 3 and 4 crosses the Arkansas River, and running east with said line to range line dividing 10 and 11 west; thence with said range line to township line dividing Townships 8 and 9 north; thence west with said line to the section line dividing Sections 3 and 4, Township 8, Range 14 west; thence south with said line to the North Fork of Cadron Creek; thence with the meanderings (following the middle of the channel) of said creek, to the middle of the Arkansas River; thence with said river to the place of beginning,” Looking at maps, Township 7 north, Range 13 West came from Conway County.
In searching both the grantee/grantor indexes and utilizing full-text search, these are the records I found in Conway County at FamilySearch. These involve members of Ebenezer’s family. I did not locate any deeds showing land Ebenezer nor his father, Jesse, purchasing.
2. Tax Record. Jesse Loveless was taxed one poll but for no land in 1869 in East Fork Township in Conway County.[5]
COMMENT: Ebenezer and his parents, along with his brother, Jesse M., were enumerated in the 1870 census in Chattooga Co, Georgia. Jesse sold land in Georgia in February 1871. Is this our Jesse?
3. Tax Record. In the 1871 delinquent tax list, T. J. Loveless had 1 pol and a value of personal property of $50, and Mrs. T Loveless no poll and a value of $185.[6]
COMMENT: T.J. Loveless is Thomas J. Loveless, husband of Jesse’s daughter, Elizabeth Loveless. They were living in East Fork Township, Conway County, Arkansas, in 1870. He did not own land at this time.[7]
4. Deed/Mortgage Record. E. Loveless witnessed, on 9 Dec 1871, a mortgage made between W. A. Loveless and U. A. Nixon, who was administrator of A. Lea’s estate, for the E2 NW4 Sec 7, T6N R13 W (80 acres).[8]
5. Deed/Mortgage Record. J. M. Loveless witnessed, on 13 Dec 1871, a mortgage made between Richard Robinson and U. A. Nixon, administrator of A. Lea’s estate, for land in SE4 Sect 35, T7N, R13W.[9] This property is just west of the land Ebenezer owned.
COMMENT: If E. Loveless is Ebenezer Loveless, then the family was in Conway/Faulkner County by December 1871. W. A. Loveless is likely William A. Loveless, Jesse’s son and Ebenezer’s brother. He married Matilda Davenport on 2 September 1869 in Conway County, and they were enumerated in East Fork Township in Conway County in 1870. He owned $200 worth of land.[10] Two of Jesse’s children migrated to Arkansas before he did.
6. Deed/Mortgage Record. On 25 Oct 1872, T. J. Loveless took out a mortgage on land described as SE4 of Sec 2, Township 6 North of Range 14 West, for $140.35 from Robert B Townsend. both of Conway Co, Arkansas.[11]
COMMENT: it is possible that the person is really F. J. Loveless, who is not known to me? Both versions were listed in the record.
7. Tax Record. In 1872, the tax record was arranged by township, range, and section. J. Loveless had the southeast quarter of Section 36, Township 7, Range 13 West. Two men owned the southwest quarter (land owned later by Ebenezer): R. Glenn (South half) and Champlin Heirs (North half).[12]
COMMENT: This tax record gives the owner of the land that Ebenezer sold to Richardson: R. Glenn and the Champlin Heirs. I found that Arnold Champlin received a patent for the northwest and southwest quarters of Section 36 in Township 7, Range 13 West in 1834. However, searching for Champlin & Glenn deeds in the indexes turned up nothing.
8. Deed/Mortgage Record Searches
I also search using full-text search on “Section 36” and on “T 7 R 13.” I next searched on “36-7-13” in Faulkner County Indexes and in Conway County Indexes.

from Robert Glenn:

index for Richardson buying land. He made two purchases in Section 36:

COMMENT: This last deed is important. F.C. Moore was a commissioner in Probate Court. The court ordered in July 1877 term the land described as Southeast Quarter of Section 36 in Township 7 North of Range 13 West be sold. This land belonged to the heirs of Jesse Loveless. It was to be sold on 3 September 1877. T.M. Richardson was the highest bidder at $786.00. Not sure why it took until 1883 to complete the sale and record it on 11 December 1884. I still do not know how Jesse obtained this land.

Pearson buying land in Section 36:

COMMENT: I have not turned up how Ebenezer obtained the land he later sold. Another way he could have gotten land was from his wife’s family. Look for Rodgers/Rogers deeds in Conway and Faulkner County. Eliza’s brother, P.K. Rodgers, had several transactions between 1874 and 1881. But that turned up nothing.
9. Jury. Jessie Loveless listed on jury, March term 1877.[18]
10. Petition. At the April 1877 term, E. Loveless was part of a petition to the County Court to put in a road from Green Brier North via W.W. Blessings shop to Sulphur Springs. It was ordered that Samuel Cooper, John Belote and E Loveless be appointed viewers to view said proposed route and report to the next turn of the court.[19]
11. Marriage Records. There were several documents of him marrying others. I will list them with the link to the record. None of the names are familiar to me. He married:

- E. Yore to Jimmie Aseneath Buple, 26 Mar 1899.[21]
- D.W. Miller to A O Venton, 22 Aug 1899.[22]
- J.H. Price to Maggie D Ruple, 5 Nov 1899.[23]
- J. G. Glover and Fannie Milam, 25 Dec 1900.[24]
- G.W. Stanton to Milicca [Melissa?] Cato, 29 Jun 1902.[25]
- Ed Glaze to Sallie Hibben, 29 Mar 1903.[26]
12. Deed/Mortgage Record. E. Loveless and Elzy Loveless sold land to W. E. Banster. Described as the northeast quarter of the southeast quarter of Section 8 in Township 7 north of Range 13 west containing forty acres.[27]
COMMENT: This is a different part of the township than the previous deed. I have not found the purchase of this land either.
13. Pauper Records. E. Loveless was listed paying $25 per month, paid up to 1 Apr 1881, for Mrs. Prip Wilson, who was put on county 27 Feb 1881. Other people were listed to pay after E. Loveless.[28]
14. Court Index. He was listed in the court index as being in book C, page 239, however, all book Cs found did not have any record of E. Loveless. It is possible that there was another set of court books not filmed.
15. Tract Book. I found Ebenezer Loveless in an Arkansas tract book for land in northwest fractional quarter of section 12 in Township 6, range 7, dated 20 Mar 1888, cancelled 5 Feb 1889.[29]
COMMENT: I wonder why it was cancelled. I sent it to Sandy Rumble to pull.
Texas
Not all records in Erath County are
open. Locked records include Commisioners court minutes (not full-text
searchable), some district court records (some are full-text searchable), and
deeds (after 1887, both full-text searchable and open). Probate and vital
records are open.
1. Marriage Records. He continued to marry couples in the Baptist church after moving to Erath County, Texas.

- William Lee Johnson to Abbie Lodina Wilson, 21 Aug 1912.[32]

- John Mathews to Mamie Boucher, 4 May 1914. And Jim Logan to Essie Mathews, 4 May 1914.[34]
- John B Mayes to Maudie Clark, 3 Aug 1918.[35]
2. Marriage. His own marriage in Erath County, as E Loveless to Mrs. M. M. Blount on 12 Sep 1908, by J.T. Adams, minister.[36]
3. Death Cert, Child. He was named as Ebbie Loveless on the death certificate of his daughter, Ida B. Hester, who died on 8 Dec 1954, Midland, Midland Co, Texas. Her mother was named Elzy Rodgers. The informant was her son, Bill Hester.[37]
COMMENT: This is a hint to how he was known to his family and friends. It is also how his wife was known, as well.
4. Death Cert, Child He was named Eb Loveless on the death certificate of his son, Robert Jessie Loveless, who died on 31 Mar 1952 in Erath Co, Texas. His Robert’s mother was named Elzie Rogers. The informant was Robert’s wife.[38]
5. Death Cert, Self. He was named E. Loveless on his own death certificate, with son, J. A. Loveless, as informant.[39]
Conclusion
This session in full-text search
turned up the records where Ebenezer conducted marriages in Faulkner and
Erath counties. I did not answer how Ebenezer and his
father, Jesse obtained their land. Deed indexes and full-text
search of names and land description did not turn up the deeds of their
purchases.
