The Family of Olivia Jane Jones – Final 12 for ’26 for August

Olivia Jane Jones married Reuben Mack Johnston on 23 December 1879 in Comanche County, Texas. They took out the license the day before and were married the next day by Q. V. Crump, Justice of the Peace.[1]

Census Records for Olivia
The marriage in December was just in time to be enumerated in January 1880:

As we can see from the place of birth for the children’s mother in Alabama, that these three children were not Olivia’s, but rather the children from Reuben’s first marriage with Catharine. Oliva was born in Mississippi about 1859 to parents born in Virginia and Mississippi.[2]

The neighbors of Reuben and Olivia included kin of Olivia: Thomas W. Jones, Bettie E. Knox, Laura E. Jones, Mattie M. Jones, and Mary F. Wright. They were all born in Mississippi to Virginia and Mississippi-born parents.[3]

In George W. Knox’ household was his 53-year-old mother-in-law, Amanda A. Jones, who was born in Mississippi to Mississippi-born parents. If the above neighbors were sisters and brothers to Olivia, then Amanda was Olivia’s mother, too.

Working backwards to 1870, Olivia lived with Amanda Jones and siblings in Hays County, Texas. Included in the household were:

Amanda led a household alone though likely the two older males helped with the farm. She did not own the land. In the 1880 census, we found Thomas W, Bettie E, Olivia J, Laura C, and Mattie M. What became of Walter, Columbus, and Ellen? In 1868, she paid tax only on a horse.[5] The youngest were five years old, so if Amanda’s husband died, it would probably be about 1864-1865.

In 1860, B. W. Jones was a farmer, born in Virginia, who headed a household in Rankin County, Mississippi.

The children line up well with those from the 1870 census. The values for his real estate and personal estate are high, much higher than his neighbors. The high value of the personal property was partly due to the seven enslaved people on his farm. He had two slave houses, a male age 38, a female age 25, a female age 20, a female age 14, a male age 5, a female age 3, and a male age 1.[7]

In 1850, the family lived in Rankin County. The family consisted of:

In comparing this with the 1860 household, Benjamin, Mary, and Walter aged 10 years. Amanda only aged 7 years. With this census, we learn that the M. F. in 1870 was Mary Jones. Olivia wasn’t born yet, making her birth about 1859, since she was 1 years old in 1860.

Mississippi also had a couple of state censuses. These did not name all inhabitants of the household, only the head. In 1866 Benjamin had four males and seven females. This matches what we know of the family:

1 male under 10: Columbus, born 1861.
2 males 10-19: Walter A Jones born 1849 and Thomas W Jones born 1850.
1 male 40-49: Benjamin W Jones
5 females under 10: Mattie M born 1865, Ellen S born 1863, Laura C born 1863, Olivia J born 1859, Bettie E born 1856.
1 female 10-19: Mary F born 1847
1 female 30-39: Amanda A born 1827[9]

However, I was under the impression that he died during the Civil War, as one of my mother’s great-uncles stated that in a newspaper interview. He claimed he was a physician with the Confederate Army, was stricken with an illness, and died.[10] This document, seems to conflict with O.D.’s story, which at best was hearsay.

In 1853, a B. W. Jones was enumerated with 4 males and 4 females, totaling 8 people in the household.[11] This does not quite match up to what is know about the family. By 1853, Mary F, Walter A., and Thomas W. were born. That would total 5 people. There is a gap between Thomas W. and the next child, Bettie E of six years, so it is possible there were other children between them, who had died. The other explanation is perhaps there were other people living in the household such as a servant, farmhand, or other family members.

Lining up the census records into a table shows the correlation better.

Amanda’s Family
Now, why did Amanda have the surname Haley written and then crossed out in the 1850 census? Living next door to Benjamin was the Thomas Haley household:

Amanda at age 25, would fit between the younger Thomas and John. Could Thomas and Elizabeth Haley be her parents?

Benjamin had two enslaved people in 1850, a 14 year-old female and an 11-year-old female. Above him, Thomas J. Haley had four enslaved people. And above him was listed Thomas Haley with eighteen males and females enslaved.[13]

B.W. Jones married Amanda A. Haley on 26 June 1845 in Rankin County, Mississippi by E.R. Strickland, G.M.[14] This explains the Haley name being crossed out in 1850. Perhaps the enumerator knew the family and thought of Amanda as a Haley.

Before his marriage, Benjamin was listed as a single in the 1845 census,[15] and taxed only on a $10 watch and a poll.[16] Three years later, he was taxed on the watch, a poll, and 2 slaves.[17] Perhaps he acquired them from Amanda’s father.

Land Purchase
A land purchase connects Benjamin to Amanda’s father, Thomas Haley. On 29 December 1851, Benjamin W. Jones and wife, Amanda A Jones, nee Haley, purchased land for $986 from the heirs of Thomas Haley. The deed named the heirs as William Haley (Asenath his wife), Mary Ann Thomas (nee Haley & widow of John B Thomas), Thomas J Haley (& wife), and John H Haley.

The land was the following:

1. the east half of the northeast quarter & the northwest quarter of the northeast quarter of Section 32 in Township 3 of Range 1 East. [E ½ NE ¼ & NW ¼ NE ¼ S32 T3 R1E]
2. the northeast quarter, northeast quarter of Section 28, Township 3, Range 1 East [NE ¼ N ¼ S28 T3 R1E]
3. the southeast quarter of northwest quarter and the west half of northeast quarter and east half northeast quarter of Section 5, township 3 Range 3 East [SE ¼ NW ¼ & W ½ NE ¼ & E ½ NE ¼ Sec 5, T3 R3E][18]

He and Amanda sold a portion of the land to Michael Harvey on 13 November 1852 for $300. The land was described as the east half of the northeast quarter & the northwest quarter of the northeast quarter of Section 32 in Township 3 of Range 1 East [E ½ NE ¼ & NW ¼ NE ¼ S 32 T3 R1E], the same land as the first tract above. This is the same land of the first tract above.[19]

In 1853, he was taxed on a clock and 5 slaves.[20] Had his wife inherited some of her father’s enslaved people? The estate papers for Thomas Haley need to be sought.

On 1 October 1856, he and Amanda sold land to John B Kornegay described as west half of northeast quarter and east half northeast quarter Section 5 Township 3 range 3 east (160 acres) [W ½ NE ¼ &E ½ NE ¼ S5 T3 R3E].[21] This piece was only a portion of the third tract he purchased from the heirs of Thomas Haley.

On the same day, they sold land to James T. Kornegay, described as southeast quarter of the northwest quarter of section 5 township 3 range 3 east, containing 40 acres. [SE ¼ NW ¼].[22] This is the other half of the third tract.

Now all he had was the middle piece of land. After conducting full-text search, I have not yet found the sale of the third tract.

In 1857, B.W. Jones paid tax on three properties in Township 3 of Range 1. Each lot was worth $350 for a total of $1050.

• SW quarter of Section 28 (160 acres)
• South half of lots 5 & 6 in Section 29 (160 acres)
• Lot 6 in Section 30 (80 acres)[23]

None of these are lands from the Thomas Haley estate. I haven’t found how he obtained these properties. Perhaps he was renting and still paid the tax.

On 5 June 1863, Benjamin and Amanda filed a quit claim deed to Thomas L. Sumrall for the land described as the east half of the northeast quarter and the northwest quarter of the northeast quarter of Section 32 in Township 3 Range 1 East, which was the land they sold to M.J. Harvey. Harvey had mislaid the deed.[24]

Court Records
Next up, is to use full-text search for “Benjamin W Jones,” “Benj W Jones,” and “BW Jones.” Below are the records found in chronological order in circuit court and probate court records. Deeds found were noted previously.

On 25 April 1844, “Benjamin Jones” was paid $4.375 for schooling for Evan Magee.[25]

COMMENT: Did he act as a teacher before marrying Olivia? Or is this a different Benjamin? There is no W. listed but I have found other records clearly our Benjamin W. without the middle initial.

On 22 March 1847, Dorcas Whitehead renounced her right of guardianship to the person and property of her son J. James Whitehead and named her friend Benjamin Jones as a suitable person to take charge of his person and property. He and Reubin McLumere were bound for the sum of $300. Benjamin became the guardian of John J Whitehead and manage the estate of the minor.[26]

Also on the same date, Benjamin W. Jones was surety for Reubin McLennore to be guardian of the estate of Mary Ann McLennore, daughter of [mother did not sign].[27]

B.W. Jones was listed in the inventory of William C. Thomas estate for a note he owed 1 January 1849 for $12.00, listed as sperate.[28] He purchased goods from the estate sale: 100 bushels corn $40.50, a bank of potatoes $4, a lot of potatoes $2.05, a chair $1.25, a saddle $10, a coffee mill $.35, a clock real $.10, a lot of sundries $.76.[29]

Thomas Haley, Amanda’s father, died 26 January 1851.[30] The division of his enslaved was held on 9 January 1852. To make the value even, some heirs had to pay other heirs the makeup value. Benjamin paid $111.66 to Thomas J. Haley. He and Amanda received Violet, age 9, and Clanda age 6. Also other enslaved were parts of lots and they received lot no. 4 and a boy Jordon.[31]

Benjamin was listed as owing $1.25 to the estate of Silas L. Steen in 1852.[32]

Benjamin served as appraiser for the L.D. Forbes estate in July 1853.[33] In August, he purchased goods from the sale of John J Peterson estate: 1 pair slippers $.35, 1 lot jogs $.15, 1 apron $.40, and 1 trunk $1.50.[34] At December 1853 court, Benjamin was allowed a sum of $25 against the estate of L.D. Forbes.[35]

At the July Term 1854 court, Thomas J. Haley filed his final accounting of the estate of Thomas Haley, deceased, and that for his administrator’s fee, he asked that each of the heirs pay him $59.83, it being one sixth of $356.03, the amount due to him.[36]

In November 1854, Benjamin Jones was allowed the sum of $7 against the estate of David Williams, deceased.[37]

On 9 August 1858, Tandy M. Wansly, administrator for the estate of Adaline Wansley, deceased, who was administrator of the estate of L.D. Forbes, deceased, gave his final accounting and mentioned that the report of Benjamin W. Jones accidentally lost his “pocket book containing a part of the vouchers of said estate and which has never been recovered” and that the accounting put forward is to the best of their ability, and that Benjamin W Jones swore to that.[38]

At the February Term 1859 court, Benj. W. Jones was ordered to appear as juror, however he did not and was fined.[39]

On 25 February 1861, Benjamin was called to serve the grand jury but did not answer and was fined $100.[40]

At the August term 1862, B.W. Jones was called to serve the grand jury but did not answer and was fined $50.00.[41]

In the January term 1863, the probate court ordered B.W. Jones with others to appraise the goods of the estate of W.C. Enochs.[42] He also appraised the estate of T. F. Wansley.[43]

In November 1863, B.W. Jones was listed as owing on a note due 1 January 1862 for $69.90 to the estate of E.E. Steen, which was recorded as doubtful.[44]

In the March 1866 term of the Circuit Court, a case numbered 8425, Benjamin Jones vs. Thos H Franklin, it was noted that the parties by attorney suggested that the defendant Benjamin Jones has departed this life since the commencement of the suit and by agreement the cause would be revived in the name of the legal representatives of said Jones.[45]

Benj. W. Jones was listed as owing a note to A.E. Martin on 14 October 1870. The note for $2.60, among many others, was listed as Desperate.[46] If Benjamin died after 1866 and his wife and children lived in Hays County, Texas, that would make the collection of the note desperate.

A Second Benjamin Jones
At the May 1858 term of the Probate Court, Wiley Jones petitioned the court to open the estate of his father, Daniel Jones, who died 18 March 1858. He left a small estate with 160 acres of land, a horse, 40 head of hogs, 2 head of cattle and farming utensils and household furnishings valued at $100. His wife died two years previously and he left seven minor children: Louis, Rebecca, Jessee, James, Harriet, Jane, and Louisa. Also the following heirs: Benjamin Jones 28 living in Jackson, Hinds County, Simon Jones 26 living in Texas, and Elizabeth Robbins wife of Jacob Robbins, living in Rankin County.[47]

This Benjamin Jones, who lived in Hinds County, was born about 1830 if his age was recorded correctly. He was about 8 years younger than Benjamin W. Jones. Although it was momentarily exciting to locate the father of Benjamin, this Daniel is likely not the father of Benjamin W. Jones.

Summary for August
I was hoping to get further back for the Samuel Johnston line during this month. I am glad to get more documentation for Benjamin W. Jones and some headway into the Haley line. Next year, I’ll focus more on Sam and Thomas Haley.
